SPONSOR. HomeAdvisor’s Denver Startup Week Contest (“Sweepstakes”) is sponsored by HomeAdvisor, Inc., 14023 Denver West Pkwy Bldg. 64 Golden, CO 80401 (“Sponsor”). Denver Startup Week and Pedal Hopper Denver, LLC are not sponsors or administrators of this Promotion. The Denver Startup Week and Pedal Hopper Denver, LLC name and logo and/or materials are used for purposes of promotion and/or prize description only and such use is not intended to suggest or imply Denver Startup Week’s or Pedal Hopper Denver, LLC’s participation, sponsorship, endorsement, or approval of this Promotion.
SWEEPSTAKES PERIOD The Sweepstakes begins on Wednesday, September 30, 2015 at 9:00 a.m. Mountain Time, and ends on Friday, October 2, 2015 at 1:30 p.m. Mountain Time (“Sweepstakes Period”). All Entries must be submitted and received within the Sweepstakes Period to be valid and eligible for the Sweepstakes.
ELIGIBILITY. Entry in the Sweepstakes is open to attendees of HomeAdvisor’s Events (defined below) at Denver Startup Week 2015, who are 21 years of age or older and who are U.S. residents. Employees of Sponsor, their immediate family members, and persons living in the same household as employees or their immediate family members are not eligible. The term “immediate family member” includes spouses, parents, grandparents, siblings, children and grandchildren. All federal, state and local laws apply.

At the HomeAdvisor Event, take a photo of the HomeAdvisor Event and tweet the photo on Twitter, tagging HomeAdvisor (@HomeAdvisor). By entering the Sweepstakes, entrants agree to follow and be bound by these Rules. All entries become the property of the Sponsor and will not be acknowledged or returned. Entries, including photos provided, may be used by the Sponsor for any lawful purpose without further permission of the entrants or any consideration apart from participation in the Sweepstakes in accordance with these Rules.
PRIZES. At the end of the Sweepstakes Period, a winner will be selected to receive a free two (2) hour Denver pedal hopper ride with Pedal Hopper Denver, LLC for up to sixteen (16) persons, who must each be 21 years of age with valid identification to ride the pedal hopper (the “Prize”). HomeAdvisor reserves the right to change the pedal hopper company to be used, in its sole discretion, and will pay the pedal hopper service directly. HomeAdvisor will schedule the pedal hopper ride on the date of the winner’s choice. The winner may redeem their ride on any Sunday, Monday, Tuesday, Wednesday or Thursday, subject to Pedal Hopper Denver, LLC’s availability (note: HomeAdvisor will not book the pedal hopper for a Friday or Saturday). One (1) Prize winner will be randomly selected at approximately 4:00 pm Mountain Time on Friday, October 2, 2015 and notified immediately via Twitter, and will be given instructions to contact publicrelations@homeadvisor.com to coordinate scheduling for the pedal hopper. Sponsor reserves the right to reject any entries where the photo submitted by Entrant is, in Sponsor’s sole discretion, distorted, inappropriate, obscene, offensive, or otherwise violates the standards of good taste, or not a photo taken at the HomeAdvisor Event. Odds of winning depend upon the number of entries received. All taxes and other expenses related to any prize are the sole responsibility of the Prize winner.
WINNERS. The Prize winner may be required to execute an affidavit of eligibility, a release of any and all liability from any claims for damages, losses or injury against Sponsor and/or any of its agents or contractors arising from participation in the Sweepstakes or acceptance and use of the Prize, a confirmation of entrant’s assignment of rights to the submitted entry materials, unless otherwise prohibited, and the entry materials, and such other forms as the Sponsor may require, including any information required for tax reporting purposes. For a winner list, please contact Sponsor at the address set forth above. The Winner hereby grants Sponsor the right to disclose the Winner’s name publicly as the Winner of this Sweepstakes.
The Prize must be claimed within seven days of notification, and winner’s affidavit and related forms must be returned executed within seven days of receipt. If the Prize is not claimed within seven days of notification or if the selected winner is found to not meet all of these Sweepstakes Rules or fails to timely provide required releases and documentation as set forth above, Sponsor will randomly select another Prize winner. If another winner is selected, any previously selected winner will have no rights to the Prize, or any other Sweepstakes benefits. This process may be repeated until the Prize has been awarded to a fully-qualifying entrant.
RELEASE AND INDEMNITY. Every entry submitted becomes the exclusive property of Sponsor, and Sponsor may therefore use and otherwise publicly display the Winner’s entry in any manner or medium. By participating in the Sweepstakes, each entrant agrees to release and hold Sponsor harmless from any and all losses, damages, rights, claims and actions of any kind in connection with or resulting from participation in the Sweepstakes and/or acceptance, possession, or use of any prizes including, without limitation, personal injuries, death, property damages. Sponsor shall not be liable for any injuries or damage to persons or property while riding the pedal hopper. Entrants further agree to indemnify and defend Sponsor from and against any and all claims relating to entrant’s entry, the photo submitted by Entrant and any use of such photo by Sponsor, or relating to entrant’s breach of any of these Rules, including without limitation claims by third parties or otherwise based on intellectual property rights, publicity rights, defamation, or invasion of privacy. Winning is contingent upon fulfilling all requirements of these Rules, and Sponsor’s decisions as to the administration of the Sweepstakes and prize awards are final.
LIMITATION OF LIABILITY. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers computer equipment, software, failure of any email to be received by the Sponsor on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Sweepstakes. Under no circumstances will Sponsor award more prizes than the prizes set forth above. In the event that any erroneous duplicative awarding of prizes occurs, the error shall be corrected and the prize awarded to the proper winner based on the criteria set forth above. If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, legal challenges, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, the Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the Sweepstakes, and to cancel, terminate, modify or suspend the Sweepstakes. Any disputes relating to this Sweepstakes or any prizes awarded in connection with the Sweepstakes shall be resolved individually without any resort to any form of class action, and any and all claims, judgments and awards shall be limited to actual out of pocket costs incurred, including costs associated with entering this Sweepstakes. Under no circumstances shall any entrant be permitted to obtain awards for other damages or have damages multiplied or otherwise increased. SOME JURISDICTIONS MAY PROHIBIT OR LIMIT EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE FOREGOING LIMITATION MAY NOT APPLY TO YOU.
USE OF DATA. Sponsor will be collecting and using personal data about participants in accordance with its privacy policy. Please review the Sponsor’s privacy policy at http://www.homeadvisor.com/rfs/aboutus/privacyPolicy.jsp (the “Privacy Policy”). By participating in the Sweepstakes, Entrants hereby agree to Sponsor’s collection and usage of their personal information as set out in its Privacy Policy and in these Official Rules and acknowledge that they have read and accepted Sponsor’s privacy policy.
JURISDICTION. Any dispute that may arise here under shall be brought solely in the appropriate state or federal court sitting in the State of Colorado, and entrants consent to the personal jurisdiction and venue of such court.
